Recreational use of all terrain vehicles has proven to be a risky business for children, even while companies that design and manufacture them reap big profits. There are countless reports of children being seriously injured and killed while riding on ATVs. Injuries typically occur when children operate ATVs that are designed for adult use only or have multiple riders on an ATV designed for one rider only.

Manufacturers market to children but fail warn about the dangers associated with children operating ATVs, or even provide instruction on how children can safely ride ATVs. There are also unreasonably dangerous design flaws associated with ATVs, such as problems with stability, proneness to rollover, and a lack of safety features.

A parental waiver or release allowing children to engage in potentially dangerous activity, such as riding ATVs, will not allow the negligent party to escape responsibility for your child’s injury. The Florida Supreme Court recently ruled that such waivers are invalid against claims for serious personal injuries and deaths.
