Parental claims are limited to monetary damages based on loss of the child’s services and for recovery of expenses in connection with the injury, such as medical expenses or funeral expenses, rehabilitation services, special education needs, and potential earnings.
The parent cannot recover for the injury itself, only the child may recover for the pain and suffering of the injury.
In extreme cases of a child’s permanent total disability or wrongful death, parents may recover for loss of filial consortium, which is a loss of companionship, love, and affection of the injured child.
In the event of a parent’s permanent disability or wrongful death, a minor child may also recover for the loss of parental companionship, instruction, guidance and mental pain and suffering.
